Catastrophic Injury Representation
What Qualifies as a Catastrophic Injury in Missouri
Missouri defines catastrophic injury by statute at RSMo 538.205 for purposes of the medical-malpractice damage limits. The statutory categories are:
● Quadriplegia
● Paraplegia
● Loss of two or more limbs
● Significant and permanent injury to the brain resulting in permanent cognitive impairment leaving the person unable to make independent, responsible life decisions and permanently unable to independently perform life-sustaining activities
● An injury that renders the person permanently blind
● Loss of a fertilized or unborn child
Outside the malpractice context the term is used more broadly, covering severe traumatic brain injury, spinal cord injury, amputation, severe burns, organ damage, permanent disfigurement, and crushing or orthopedic injuries with permanent consequences.
How These Cases Are Built
Damages and Compensation in a Missouri Personal Injury Case
Economic damages
cover measurable financial loss: emergency and ongoing medical care, long-term rehabilitation, home modifications and assistive technology, lost wages and future earning capacity, and property damage. Missouri does not cap economic damages in ordinary negligence cases.
Non-economic damages
cover pain and suffering, loss of enjoyment of life, emotional distress, permanent disfigurement or disability, and loss of consortium.
Where limits apply.
Missouri caps non-economic damages in medical-malpractice actions under RSMo 538.210, with separate limits for catastrophic and non-catastrophic injury. Those figures increase 1.7% annually, so any amount quoted without a year attached is unreliable — the current published amounts come from the Missouri Department of Commerce and Insurance. Claims against a public entity are separately capped by RSMo 537.610.Our Process

We gather medical records, accident reports, witness statements, surveillance footage, and all available evidence to build a foundation for the claim. Surveillance video is commonly overwritten within seven to thirty days, so this begins immediately.

Deadlines matter. Most Missouri negligence claims are subject to a five-year limitation under RSMo 516.120.
Wrongful death is three years under RSMo 537.100. Medical malpractice is two years under RSMo 516.105, with
exceptions for minors and for certain discovery situations. Claims against public entities can carry much shorter notice
requirements. More than one deadline can apply to a single incident.
